It will be interesting to see how they differentiate between illegal and
legal downloads. I get a lot of conference talks as mp3 downloads from
bittorrent and I'm sure there are lots of people who download legal
music in the same way.

Whatever they do people will find a way around it, all it takes is to
encrypt the download channel and the ISP can't sniff the traffic so
won't know what is in there.
