The argument presented falls under the classical 'straw man' fallacy. The 
principle of charity is not used in the construction of the case. That is the 
person putting forward their case does not put forward a true and full 
representation of the opposing (Open Source) case. A weakend opposing 
argument is put forward purposefully so as to give a false impression of the 
strengths of the argument the author is trying to present - Making the author 
a 'Man of Straw'.

This begs the question, 'why is this man putting forward what is reality a 
weak argument in support of Microsoft:)' Might be because the proprietary 
case is in reality weak!!!
