As far as I know this aspect of Microsoft's greed has not been 
questioned.  But, if you are subscribed to any of the U.S LUG lists 
then you will see discussion about the issue of MS licences and 
schools.   The general comment is that the EULA has not been tested 
with a court case when it comes to schools and so any attempt by MS 
to put a legal case into court would fail.

However, that's on American turf.  Over here the legal profession are 
not all that well known for representing the best interests of their 
own clients.  Money and greed are the law in this country.
